2024年6月6日，被告费某醉酒后驾驶车辆与行人邓某、樊某相撞，造成两名受害人死亡。经鉴定，费某血液中乙醇含量达到222.7mg/ml，交警部门认定费某负事故的全部责任。

受害人邓某与樊某系祖孙，事故发生时邓某接近70岁，而樊某仅有几个月大，二人的离世给原本温馨和睦的家庭笼罩了一层阴霾，造成了难以弥补的经济和精神损失。事故发生后，受害人家属向费某方提出170余万元的赔偿要求。乡镇司法所组织当事人进行了多次调解。但因赔偿金额较高，保险公司以费某涉及酒驾为由拒绝理赔，费某虽极力筹措了20万元赔偿金，各方仍未能达成调解协议。

通过案件的诉讼保全，未能查到费某名下有可供执行的财产。法官经多方走访调查，摸清了费某的基本经济情况。费某50多岁，患有疾病，家中有85岁的母亲需要赡养，无亲生子女，再婚后有3个继子女，其中一名子女患有严重的先天性精神障碍。费某在物业公司从事回收生活垃圾以及搬运工作，名下财产仅有位于旅游区的农村自建房一处，该房屋现租赁了部分，有房租收入。

在前期沟通过程中，受害者家属情绪激动，不愿对赔偿金额让步，甚至要求处置费某农村宅基地房屋。法官耐心安抚受害者家属情绪，一方面从执行宅基地房屋的可行性与合法性上向受害者家属做了解释说明工作，另一方面告知受害人家属现阶段和解的“好”与判决后执行不能的“坏”。
