近日，洪雅县法院柳江法庭运用多元解纷机制，邀请省人大代表和当地村干部共同参与，到当事人居住地黑山村以“坝坝会”的形式开展巡回调解，一调解两纷，案结事了人和。

2022年10月，80多岁的李某中在一起交通事故中死亡，司机王某全责。其唯一的亲生子李某某诉至洪雅县法院柳江法庭，要求保险公司及交通事故责任人赔偿相关损失共计30余万元。

在诉讼过程中，一名老人张某某和她的两个儿子申请作为原告参与该案诉讼。张某某称，她与李某某自1992年起，便以夫妻名义共同居住生活，至今已有30余年，形成了事实婚姻关系，且她的儿子对李某中尽到了部分赡养义务，形成了事实上的继子女关系。

这个案件，看是一起简单的交通事故的案件，其实还包含了赔偿金的分配问题。

”在了情案情后，承办法官胡婷认为，从情理法的角度，都应当在分配死亡赔偿金的时候考虑张某某的份额，但亲生子李某某与老人张某某关系并不融洽。

如果仅就交通事故赔偿案件简单一判了之，李某某和张某某极有可能因为赔偿金的分配问题再度诉至法院。

两当事人居住在偏远的高庙镇黑山村，且张某某已年逾80岁，身体欠佳。为方便当事人，避免重复诉讼，柳江法庭决定到黑山开展巡回调解，将交通事故赔偿与赔偿金分配问题一并化解。
